Deluded wife killer Joe O’Reilly believed murderer Graham Dwyer’s appeal was his own last hope at freedom.

Dwyer, 51, who brutally murdered childcare worker Elaine O’Hara in 2013, has now exhausted all legal avenues after the Supreme Court ruled against his appeal last week.

Now sources have told the Irish Mirror how 52-year-old O’Reilly, who murdered his wife Rachel Callaly in 2004, mistakenly believed Dwyer’s case would help him, if he won.

One said: “From the moment Dwyer took his case O’Reilly was telling anyone who would listen it will help him. He really believed the phone evidence and privacy laws were all that were keeping him in prison.

“If Dwyer won, he was going to see if that opened the door for him to launch an appeal of his own. Now he’s realised that it was going nowhere. He is really that deluded.”

O’Reilly was convicted over crucial mobile phone evidence although his conviction pre-dates the European law that Dwyer raised in his challenge. But the killer, who has never admitted his guilt and whose appeals have been dismissed, failed to grasp that fact.

Sources say the delusional killer mistakenly believed that if Dwyer was successful, it would clear the way for him to launch his own case to challenge the phone evidence that nailed him.

One added: “He was waiting patiently for that decision last week as he felt all that held him was the phone data. He has still not admitted the murder or accepted the sentence, never engaged with the services and now he is totally screwed.”

Twisted O’Reilly now works in the tuck shop of the Midlands Prison, which also holds Dwyer. The pair have had an odd relationship over the years, having met in a holding cell.

Dwyer is alleged to have asked his fellow inmate: “Are you the real Joe O’Reilly?”

Sources previously revealed he thought Dwyer was a “gobs***e,” following the bizarre encounter.

Over the last number of years, Dwyer brought his case to the High Court, Court of Appeal and Europe. Mobile phone data helped tie him to Elaine’s murder, linking him to a phone used to send messages to her and to specific locations.

His trial was told a Nokia phone found in Vartry Reservoir in Co Wicklow in 2013 was used to send her messages, including one about stabbing, culminating in a text on August 22, 2012, the last day she was seen, to “go down to the shore and wait”.

The prosecution argued that handset, and another phone found in the reservoir, were so-called “Master” and “Slave” phones they used almost exclusively to contact each other.

Following his conviction, Dwyer brought his case before the Court of Justice of the European Union where he successfully challenged the validity of section of the legislation which permitted metadata to be retained “on a general and indiscriminate basis”.

In a bombshell ruling in April 2022, it found Ireland’s data-retention regime breached EU law. But in March last year, the Court of Appeal here dismissed Dwyer’s earlier challenge and said the metadata evidence, which it described as “not very significant”, was admissible.

It held that, even if that data were excluded, there was enough evidence to link Dwyer to the two phones that formed part of the prosecution case.

Dwyer then secured a further appeal before the seven-judge Supreme Court – which last week also ruled against him.

O’Reilly, who is also serving life in prison, was finally snared after gardai could prove his phone pinged near the scene of the murder in Naul, north Co Dublin, when he had claimed he was at work.

Refusing to take responsibility for his crime, he is still awaiting a decision by the Parole Board which is yet again hearing his pleas for freedom – after 17 years behind bars. Speaking to us earlier this year, murder victim Rachel’s mother Rose said she will never stop fighting to keep O’Reilly behind bars.

Mrs Callaly, who lost her husband Jim earlier this year, said: “I will never let that happen. There will be no let up. I feel now more stronger than ever and I feel he’s not 17 years in yet and that for a life that he planned to take, there’s no give to me at all.

“If I had my way he’d be in jail for the rest of his life and I think he would be getting off lightly then. At least he has a life and it’s more than he gave his wife. As long as I have life left in me I will fight to keep him in.”
